Home Acceptable Use Policy

 Acceptable Use Policy (AUP)

 
To use Viaspec products and services, you must comply with the provisions of this Acceptable Use Policy ("AUP") and/or Fair Usage Policy ("FUP") at all times. This AUP which incorporates the broadband FUP below, must be read in conjunction with our “Terms and Conditions”, which is available and accessible from our home page at www.viaspec.com.

Please note that in this AUP, "we"/"us"/"our" denotes Viaspec Ltd, company registration number 07452589, registered office 145 – 157 St John Street, London EC1V 4PW, and "you"/"your" denotes you the customer.

Please ensure that you are in possession of the latest copy of this AUP.


GENERAL INFORMATION

Customers shall refrain from sending, receiving, streaming any form of traffic that may be deemed to be, at our own discretion, unlawful, fraudulent, criminal or otherwise illegal activity.

Refrain from sending, receiving, streaming content which you should reasonably know could not have been legally obtained, streamed or distributed.

Refrain from transmitting or launching knowingly or negligently, denial of service (DoS), mail bombing, virus or flooding attacks, unsolicited emails, advertising or promotional materials.

It is the Customer's sole responsibility to ensure that up to date contact and billing information held by Viaspec is current. All notification correspondence by post, fax or email sent to contact details on file will be deemed to have been read and action may be taken on the basis of this assumption.

The customer must not engage in practices that could have negative impacts on our or our suppliers' network; this includes but is not limited to the use of peer to peer networking, excessive and constant "bandwidth hugging" activities and the use of diallers. If the use of diallers is part of your normal business activity, please contact Customer Services to discuss this in detail and to eventually gain permission.


 BROADBAND FAIR USAGE POLICY

 The Viaspec Broadband FUP applies to all our broadband products and variants of these products unless otherwise stated.

 It is in place to ensure that we can continue to provide an acceptable standard of service in terms of download speeds, to the vast majority of our customers.

We continually measure the performance of our services and take steps to restrict usage during peak periods (excludes products with network prioritisation and, ADSL2+ Standard and Premium) which may contribute significantly towards the risk of a reduced quality of service being experienced by the majority of our broadband customers. The peak period is currently 8am to 11pm. The peak period may be subject to change dependent on usage patterns across the network.

Usage will be monitored on a continuous basis. Customers that exceed the permitted data download over a rolling 30 day period will be affected by the Viaspec FUP. This is currently defined as per the limits detailed below, although we reserve the right to amend these limits in accordance with the terms of your Agreement. Please note that the permitted download totals only apply to peak usage. Off peak usage remains unlimited.

Permitted data download over rolling period of 30 consecutive days.

Home Office+ - 60GB of total data download during peak period. This is unlimited off peak.

Business ADSL2+ Pro & Lite - 200GB of total data download during peak period. This is unlimited off peak.

Any Customers who are affected will be notified via email if their speed is being restricted. Where possible, we will always endeavour to provide advance notification by email to Customers approaching the limit.*

Speed restrictions will only apply during peak periods. Should a Customer's usage return to acceptable levels, adjudged on a rolling 30 day period, speed restrictions will be removed.

* In certain circumstances, it may be possible to exceed the limit in an extremely short period of time (e.g. 24-48 hours) and in such circumstances, you may not be notified in advance of the speed of your service being restricted.

Please note that the violation of any of the above-stated AUP/FUP conditions may result in Viaspec terminating your services and deleting any available accounts.
